Chapter 7 Bankruptcy
Chapter 7 bankruptcy gives many people a fresh start at life because it completely eliminates all dischargeable debt forever. However, not all types of debt can be cleared under Chapter 7. Secured debts, such as student loans, taxes, child support, alimony, and personal injury damages cannot be cleared through Chapter 7. In order to be granted bankruptcy under Chapter 7, you must prove to the court that there is no realistic way you can repay all of your debts under a restructuring plan. Once Chapter 7 is awarded, you are dismissed from having to repay any of your unsecured debts, and are usually allowed to keep all of your assets. After bankruptcy has been granted under Chapter 7, your creditors will be informed of the bankruptcy and are no longer allowed to harass you.
Chapter 13 Bankruptcy
People who are ineligible for Chapter 7 bankruptcy often find relief under Chapter 13. Most people in need of Chapter 13 bankruptcy are typically too far behind on their bills and other financial obligations to catch up without legal intervention. Many hardworking people and families have turned to Chapter 13 to get their finances back on track. However, unlike Chapter 7, Chapter 13 bankruptcy does not completely eliminate a person’s debts. Instead, Chapter 13 restructures a person’s debt and consolidates it into a feasible payment plan that he/she can pay overtime. Under 13 bankruptcy, people are usually able to keep their homes, businesses, and cars while they pay off their debts over time.
